Trial Date Set for Man Charged in February N. Calhoun Avenue Non-Fatal Shooting

On June 28, Michael Middleton and his attorney, Maureen O’Leary, appeared before Baltimore Circuit Court Judge Melissa M. Phinn to schedule his trial. 

After Middleton, 37, rejected a plea offer from the prosecutor assigned to the case, Judge Phinn set his trial date for Oct. 4 before Judge Martin H. Schreiber II

For firearm possession with a felony conviction, the plea offered 15 years, suspending all but six. For illegal possession of a regulated firearm, Middleton could have served 15 years, suspending all but 90 days concurrent to the possession charge. For firing a gun in Baltimore City, the offer was one year to run consecutive to his other sentences. His first five years would have been without the possibility of parole. He also would have been required to register as a gun offender and complete five years of supervised probation. 

Middleton is also charged with possession of firearms in a controlled dangerous substance offense, having a loaded handgun on his person, having a handgun on his person, having a gun within 100 yards of the public, concealing a deadly weapon, reckless endangerment, intoxicated endangerment, being intoxicated and causing a public disturbance and disorderly conduct in connection to a February 23 incident.

According to court documents, a Baltimore Police Department officer on patrol heard gunshots and responded to the 1700 block of N. Calhoun Avenue, where he saw the defendant with a handgun pointed in the air. Middleton reportedly smelled strongly of alcohol. Officers recovered 14 9mm shell casings from the scene.
