On July 22, the jury trial for a co-defendant of a murder was postponed after a judge ruled that the defense had the right to investigate one of the prosecution’s eyewitnesses.
Garry Morris, 24, is charged with two counts of first-degree murder, firearm use in a felony violent crime and having a handgun in a vehicle in connection to an incident in December 2022 that killed 20-year old Amare Burruss on the 4200 block of Pimlico Road.
Defense attorney Mary Patton motioned to exclude a last minute eyewitness or postpone the trial as she was not able to properly investigate and interview him beforehand.
Baltimore City Circuit Court Judge Jeannie J. Hong decided that the defense had the right to investigate this eyewitness, as he was pertinent to the prosecution’s argument.
Judge Melissa K. Copeland approved the postponement. She scheduled the new trial date for Nov. 13 in front of Judge Althea M. Handy.
Morris’ co-defendants include Wesley Lambert, 22, who was convicted of killing Burruss and will be sentenced Aug. 1, and Darrean Fleming, 24, who had a mistrial, and is set to have a new trial Sept. 25.
