Non-Fatal Shooting Defendant Found Competent, Criminally Responsible

Deonte Anthony Simms, 32, and his defense attorney withdrew a not criminally responsible (NCR) plea in Baltimore City Circuit Court’s mental health division on June 4. Judge Gale E. Rasin presided over the hearing. 

Simms, whose trial was postponed June 3 due to administrative concerns regarding his mental competency, faces nine firearm-related charges for allegedly discharging a gun in his apartment during a mental health crisis on Jan. 28, 2024. No injuries were sustained during the incident. 

Simms’ attorney, Michael Tomko, reviewed a doctor’s opinion the night prior to the hearing that deemed Simms criminally responsible at the time of the incident. 

“I don’t think we have any questions about competency at all,” Tomko told Judge Rasin. “The doctors don’t.”

Simms has yet to receive a trial date, and Maryland Judiciary Case Search records have not yet been updated to reflect further scheduling.
