A mental health competency test was ordered by the defense for a murder defendant undergoing a retrial on Nov. 7 before Baltimore City Circuit Court Judge Melissa Phinn.
Anthony Burris is charged with firearm use during a felony violent crime and second-degree murder in connection to the shooting of 31-year-old Earl Burton on Oct. 31, 2015, on the 1100 block of Laurens Street.
During a reception court hearing, the prosecution disclosed that she did not propose a plea offer as Burris’ defense attorney, Michael Lawlor, awaits the results of his client’s mental health competency test.
According to the Office of the State’s Attorney for Baltimore City, Burris, 23, and Burton traveled together in the same vehicle on the night of the incident. Upon arriving at their destination, Burris allegedly fired a fatal shot to Burton’s head as he exited the car.
Burris reportedly fled the scene following the shooting.
At the court proceeding, Lawlor reported that he filed Burris’ competency evaluation “a few weeks ago.” However, he failed to provide an estimate as to what date they expect these results to be processed.
In the interim, Judge Phinn ordered parties to attend mental health court before Baltimore City Circuit Court Judge Gale E. Rasin on Nov. 9 to further discuss the defendant’s status.
