A Baltimore man’s attempted murder trial was declared a mistrial on Oct. 3 after jurors failed to reach a unanimous verdict on his 19 charges.
Dionte Cain, 31, was charged with attempted murder, assault, armed robbery, and multiple gun and conspiracy violations in connection to a shooting that occurred April 2, 2024, on the 3900 block of Greenmount Avenue. Darnell Johnson, 28, is also charged in this case.
Johnson previously testified against Cain at trial, alleging he picked Cain up to go to the Family Dollar store located on Greenmount Avenue. Cain reportedly asked Johnson to stop the car, saying he needed to “get some money.” After exiting Johnson’s vehicle, Cain walked towards a nearby truck.
When Cain returned to Johnson, he allegedly confessed to shooting a man sitting in the truck, saying “he was going to hit him with his car.” Police responding to the incident location found the victim suffering from gunshot wounds to his left wrist and right thigh.
The jury found Cain not guilty on one count of attempted first-degree murder, but guilty of having a loaded handgun on his person. The court declared a mistrial on his remaining counts, which include attempted second-degree murder, armed robbery, first-degree assault, reckless endangerment, seven conspiracy charges, and five handgun charges.
Baltimore City Circuit Court Judge Kimberly C. McBride presided over proceedings.
Cain is set to receive a retrial date on Oct. 10.
