Man Accused of Attempted Murder Agrees to Stay Away From Victim, Case on Stet Docket

A Baltimore man charged with attempted murder agreed to the prosecution’s conditions to stay away from the victim in exchange for indefinitely postponing his case.

During reception court on June 9, the prosecution offered to put 37-year-old Tony Graham’s case on Baltimore City Circuit Court’s stet docket as long as the defendant agreed to stay away from the victim in connection to an incident on March 27, 2020.

Graham was arrested for allegedly shooting a 26-year-old man on the 5100 block of Park Heights Avenue and charged with attempted first and second-degree murder, first and second-degree assault, reckless endangerment, firearm use during a felony violent crime, having a handgun on his person, carrying a concealed handgun, and illegal possession of ammo.

The defendant, who was represented by defense attorney Jonathan Kerr, agreed to the prosecution’s stipulations.

Judge Melissa M. Phinn informed Graham that the prosecution and defense can reopen the case within one year. Only the court has the ability to reopen the case after the first year, she said, and after two years, the charges can be expunged.
