Judge Sets Trial Date for Assault Co-Defendants for End of 2022

On Sept. 29, two co-defendants charged with assault, one of them charged with attempted murder, had their trial date set before Baltimore Circuit Court Judge Melissa Phinn.

Daron Smith and his 36-year-old co-defendant are charged with first and second-degree assault, use of a firearm during a felony violent crime, and discharging firearms in connection to an incident on May 2.

Smith, 21, is also charged with first and second-degree attempted murder, illegal possession of a regulated firearm, and illegal possession of ammo.

Smith and his defense attorney Maureen O’Leary rejected the plea of 15 years, suspending all but five years with three years supervised probation for first-degree assault; five years in prison without the possibility of parole for the use of a firearm during a felony violent crime.

The co-defendant and her defense attorney James Sweeting rejected the plea of five years, suspending all but time served with five years probation for second-degree assault.

Johnson will be tried with his co-defendant on Dec. 28. The trial is expected to last two days with Judge John A. Howard presiding.
