Judge Continues Hearing For Attempted Murder Defendant Undergoing Retrial

During a Dec. 8 reception court proceeding, Baltimore City Circuit Court Judge Melissa Phinn continued a hearing for a defendant accused of attempted murder in 2009. The man is currently undergoing a retrial.

Finksberg resident Andrew Hyle is charged with attempted second-degree murder and handgun use in committing a crime for his alleged involvement in an incident on Aug 8, 2009.

At Monday’s hearing, the prosecution failed to pose a plea offer, informing the court he was not prepared as he inherited the case on Nov. 21.

Judge Phinn granted the parties a continuance. Hyle’s defense attorney, Jonathan Kerr, did not object. 

The 31-year-old defendant has been incarcerated for 13 years, having been arrested on Aug. 29, 2009 after opening fire on a crowd and striking two people.

Parties are expected to reconvene on Dec. 14, where the prosecution will propose a plea offer before the court.
