Judge Cites Seriousness of Case in Bail Denial

A defendant was denied bail Oct. 7 during his bail review hearing at the Baltimore City Circuit Court.

The defendant, who is a juvenile, is charged with handgun possession.

However, according to the prosecution, although the juvenile is only being charged with handgun possession the incident in which the charge came from was serious and put several pedestrians in danger.

The prosecutor said a video of the incident, which occurred on July 10 on the 1400 block of East Fayette Street, located in East Baltimore, shows the defendant firing a gun at a parked car as a passenger in that car was getting out.

A shoutout ensued and police found multiple shell casing at the crime scene, which is along a busy four lane highway.

No injuries were reported, nor did police find a gun.

The juvenile’s defense attorney challenged the prosecution’s statement that placed the juvenile on the scene because they juvenile was not in possession of a gun when apprehended.

The defense attorney also said a trial is scheduled to occur on Jan. 19, 2022, and a motion has been filed to transfer the defendant’s case to the Department of Juvenile Services for Baltimore City.

According to the defense attorney, there is a backlog, but she hopes the transfer happens before the trial.

As the defendant waits for trial, his defense attorney requested placing him on home detention, citing health concerns with high blood pressure and depression. Home detention can minimize any threat, the defense attorney told Judge Jeannie J. Hong.

However, Judge Hong said the allegations from the prosecution and a prior handgun conviction in 2019 were serious, which is why she decided to not change the defendant’s bail status.
