A 32-year-old man convicted of attempted murder nearly 10 years ago was sentenced to an additional five years in prison for violating his probation.
In May 2014, defendant Charles Smith was offered and accepted a plea of 15 years, suspending all but 10 years, and five years of supervised probation for attempted second-degree murder and a concurrent 15 years, suspending all but 10 years, for firearm use in a felony violent crime.
Smith was charged with violating his probation this year, and on Feb. 23, he was sentenced to five years for attempted second-degree murder to run consecutively to his 2014 sentence and five years for firearm use in a felony violent crime to run concurrently to the aforementioned five years.
Baltimore City Circuit Court Judge Audrey Carrion presided over Smith’s proceedings in 2014 and 2023.
According to court documents, the attempted murder stemmed from an incident on Aug. 24, 2012, when Baltimore Police were called to the 800 block of Herndon Court for a reported shooting. Police found the victim conscious with a gunshot wound to his right cheek and right buttocks.
The victim was taken to a nearby hospital for treatment.
Police learned the shooting occurred on the 4100 block of Duane Avenue, and the victim identified Smith through a photo array.
