A Finksburg man was denied bail on Aug. 30, more than 12 years after he accepted a plea agreement for four counts of attempted murder.
Andrew Hyle, 31, returned to Baltimore City Circuit Court after successfully appealing his guilty plea earlier this year. Hyle’s defense attorney, Jonathan Kerr, told Judge Cynthia Jones on Tuesday that the defendant was coming up on 13 years of incarceration as part of his overall plea agreement from June 2010.
The details of Hyle’s plea were not discussed during the proceedings; however, Kerr said the defendant accepted a guilty plea to four counts of attempted murder when he was 18-years-old. Post-conviction relief was granted in July, and the case was remanded back to court due to ineffective assistance of counsel.
Since his incarceration, Kerr said, Hyle has earned his GED and completed several programs.
“Clearly, he’s a very different person at 31 than 18-years-old,” said the defense attorney, who requested Hyle’s release to home detention, where he would live with family in Parkville.
An assistant state’s attorney standing in for the lead prosecutor asked for no bail, reminding the court that Hyle was arrested, charged, and convicted for firing a weapon into a crowd of people, hitting two, on Aug. 29, 2009. Five witnesses later identified Hyle in a photo array.
Judge Jones said she found no reason or condition for Hyle’s release and denied his release.
Hyle is scheduled to appear in reception court on Dec. 9.
