A 20-year-old attempted murder defendant’s defense counsel motioned for dismissal based on his client’s physical make-up. The victim said the suspect was 5’6″ tall, although Darius Partlow is 6 feet tall.
Partlow is charged with attempted first-degree murder, attempted second-degree murder, first-degree assault, use of a firearm during a violent crime, reckless endangerment, possession of firearm as a minor, and unauthorized handgun on person in connection to an incident on July 4, 2020.
Prior to jury selection, Partlow’s defense attorney, Benjamin Charlton, motioned to dismiss the consideration of the defendant’s physical make-up since it differs from the victim’s description throughout the court proceedings.
Baltimore City Circuit Court Judge Jeffrey M. Geller has not yet decided whether to grant or deny the motion.
Partlow’s jury trial began on June 22.
