Baltimore City Circuit Court Judge Jennifer B. Schiffer heard a defense motion to compel the prosecution to disclose relevant evidence during the discovery phase of a trial on Aug. 27.
Terrance Peterson, 34, is on trial for the armed robbery and murder of Carmen Rodriguez, 36, that occurred on Dec. 12, 2019, at Kim’s Deli on the 100 block of N. Kenwood Avenue.
Peterson’s defense attorney, Deborah Levi, argued the prosecution failed to give the defense enough time to review the material given that Peterson’s trial is set to start on Sept. 9.
Levi was also concerned with the discovery and storage of digital evidence. She she requested the original police documents and pertinent video footage, but received only copies, some of which contained redacted information. Levi noted that “digital evidence can be manipulated,” and that reviewing evidence in its original form is crucial to Peterson’s defense.
Judge Schiffer will rule on the defense’s motion to compel prior to the Sept. 9 trial. Until then, she has ordered the unredacted police files per the defense’s request.
