Tyrone “Ty” Gerald White, 42, will head to trial a day after rejecting a plea offer on Aug. 11 for the 2017 murder and robbery of Daniel “Danny” Brinkley, 24.

White faces charges of first degree murder, first degree assault, robbery and multiple other gun related charges for the fatal shooting, which occurred Oct. 2, 2017 on the 1300 block of Myrtle Avenue.

During the hearing, defense attorney Brandon Taylor informed Judge Lynn Stewart Mays that his client was opting for a trial. Judge Mays expressed surprise, citing extensive evidence against the defendant that included eyewitness testimony, DNA recovered from a brown leather jacket, cellphone records and a journal.

The prosecution offered a deal of life, suspending all but 20 to 38 years, a more lenient alternative to the maximum penalty of life plus 35. Judge Mays cautioned that jury trials are unpredictable and said the “jury can be like rolling dice,” varying from day to day.

White expressed concern about the lengthy sentence offer, and noted he has an 11-year-old daughter.

Despite the judge’s admonitions, White chose to reject the plea.

White’s seven-day trial is scheduled to begin on Aug. 12 before Judge Mays and a panel of 12 jurors.
