Baltimore City Circuit Court Judge Melissa M. Phinn recalled the case of Joseph Wise, 56, on Aug. 5 after counsel submitted new evidence in his defense. The case was also postponed pending the return of the initial prosecuting attorney.
Wise is charged with reckless endangerment, malicious destruction of property and discharging a BB gun in relation to an incident that occurred April 5. In particular, shooting a BB gun through a woman’s window more than ten times, shattering it and damaging other property. The woman, who was reportedly standing in front of the window at the time, later identified Wise as the alleged shooter. She also referred to Wise as an acquaintance and claimed he’s done the same things before.
During the hearing, Wise’s stand-in defense attorney claimed Wise was innocent and not present in Maryland when the crime occurred.
The prosecution offered Wise a three-year suspended sentence, which Wise rejected.
Wise previously faced second-degree assault charges for allegedly attacking an unnamed individual with a BB gun in March. The state declined to prosecute Wise on those charges.
The court has yet to set a trial date for the case.
