A second murder trial for a defendant, who was convicted for murder in a previous incident, was postponed Jan. 21.
Thirty-seven-year-old Everette Schwartez, who’s currently serving 39 years for the Jan. 21, 2021 murder of 46-year-old Tavaughn Anderson, faces new murder charges for the Feb. 1,2021 murder of 34-year-old Timothy Orem. Orem was shot and killed on the 3600 block of Shelby Avenue.
Shortly after, Baltimore City Circuit Court Judge Alan C. Lazerow called the case, the prosecutor requested a postponement, stating his second-chair was out with COVID.
The prosecutor said he didn’t want to proceed without the second chair because the second prosecutor prepared nine out of 19 of the prosecution’s witnesses.
Judge Lazerow told the prosecutor that if he were second chair in this case, despite illness, he would’ve wanted his case to move forward
Even though Jason Rodriguez, Schwartez’s defense attorney, did not object to the postponement. Judge Lazerow wanted to hear from the defendant.
Schwartez stated that he was unsure how this postponement would affect him.
Judge Lazerow granted a postponement and sent the case to reception court to be rescheduled.
In reception court, Baltimore City Circuit Court Judge Melissa K. Copeland also questioned the prosecutor’s decision to not move forward.
However she re-set the trial was for April 20 which he is expected to last for four days before Judge Lazerow.
