The case for a Baltimore man accused of attempted murder was dismissed by a prosecutor on Aug. 8 before Baltimore City Circuit Court Judge Lynn Stewart Mays.
Damian Palmer, 48, was charged with attempted first and second-degree murder, first-degree assault, use of a firearm during a violent crime, reckless endangerment, possession of a firearm with a felony conviction, discharging a firearm within Baltimore city and having a handgun on person in connection to an incident on Aug. 21, 2021.
The prosecution decided to Nolle Pros the case due to being unable to find the witness, who initially identified the defendant, putting him at the scene of the crime.
The prosecutor said he checked both of the witness’ homes in Baltimore and Pennsylvania but he was never found. Plus, the prosecutor has not been able to contact him.
Palmer was represented by defense attorney Stephen Tully.
According to CBS Baltimore, on Aug. 21, 2021, police responded to the 6300 block of Belair Road around 12:49 a.m. for a reported shooting. Officers discovered a 29-year-old male with a non-life-threatening gunshot wound to the shoulder.
According to the police, the victim was shot after a dispute.
