Acquitted: Attempted Murder Defendant Headed to Trial in December in 2022 Greenmount Avenue Shooting Case

“My client rejects this offer and continues to reject it,” said a defendant’s new lawyer after hearing the prosecutor’s plea offer before Baltimore City Circuit Court Judge Melissa M. Phinn on Aug. 30.

Defendant Davon Harold Austin was offered  a plea of life, suspending all but 45 years for attempted first degree murder, a concurrent sentence of five year without the possibility of parole for firearm use in a felony violent crime, and an additional consecutive five year sentence without the possibility of parole for firearm possession with a felony conviction.

“He rejects it. Continues to reject it,” responded defense attorney Jason Rodriguez on behalf of the defendant.

Judge Phinn scheduled for the defendant to start trial on Dec. 11.

According to the Baltimore Police Department, investigators believe Jenkins was the cause of a non-fatal shooting of a 17-year-old victim and another victim on the 1200 block of Greenmount Avenue on April 29, 2022. Jenkins was arrested in October 2022. 

Jenkins is charged with two counts each of attempted first- and second degree murder, firearm use in felony violent crime, two counts each of first- and second- degree assault, reckless endangerment, illegally possessing a firearm, possessing a firearm with a drug conviction, illegally possessing ammo having a handgun on his person and discharging firearms.
