Alleged Gang Member Receives Trial Date

Baltimore City Circuit Court Judge Melissa M. Phinn scheduled a trial for a 22-year-old murder defendant accused of gang-related murders.

Datwain Jackson is charged with conspiracy to participate in a criminal gang, participating in a gang resulting in death, conspiracy to do a lawful act by unlawful means, first-degree murder, attempted first-degree murder, second-degree murder, firearm use in a felony violent crime, firearm possession with a felony conviction, illegal possession of a regulated firearm, possession of a firearm in a controlled dangerous substance offense, having a loaded handgun on his person and having a handgun on his person in connection to a Jan. 1, 2019, incident.

The stand-in assistant attorney general put on the record a plea offer that defense attorney Augustine Okeke said had been previously rejected. The offer entailed 10 years in prison for conspiracy to participate in a criminal gang, 20 years for participating in a gang resulting in death and five years without the possibility of parole for firearm possession with a felony conviction. The assistant attorney general did not specify if the sentences would be consecutive or concurrent.

Judge Phinn scheduled Jackson’s eight-day trial to begin on May 29, 2024.

Jackson’s indictment named him as a member of a gang, but did not specify the names of the people he allegedly killed.
