Man Charged with Murdering Woman, Toddler, Unborn Child Has Trial Delayed Third Time after Prosecutor Admitted to Hospital

Tripe homicide defendant Devon Sample had his jury trial postponed for the third time in one year after the prosecutor assigned to the case was admitted to the hospital.

On April 4, an assistant state’s attorney standing in for the assigned prosecutor informed Baltimore City Circuit Court Judge Melissa Phinn of the prosecutor’s status and requested a postponement for Sample’s case. Despite defense attorney Roland Brown’s objection, Judge Phinn scheduled Sample to return to reception court on April 12, when a new trial date will be decided.

Sample, 27, is facing three counts of first-degree murder for the death of Shiand Miller, her unborn son, and her daughter, Shaniya Gilmore, on June 18, 2020. CBS Baltimore reported that Miller and Gilmore’s bodies were found inside a car on the 200 block of Boswell Road in Baltimore’s Westgate neighborhood.

Miller was eight months pregnant at the time of her murder.

The defendant was initially scheduled for trial in April 2022, which was postponed due to Brown trying another case. In December 2022, Sample’s trial was delayed once more at the request of defense counsel in order to allow more time to review the case.
