A motion to dismiss a mass shooting case was denied in a March 27 hearing.
Deion Briscoe, 30 is charged with multiple counts of attempted murder, conspiracy and firearm use in connection to a Carrollton Ridge mass shooting that left four teenagers and a woman injured.
Briscoe’s 21-year-old co-defendant, Carlos Steven Dixon, is set to be tried separately on April 17.
During the hearing, defense attorney Avrohom Greenfield filed a motion to dismiss the case, claiming the state handed Briscoe two additional firearm charges after charging him with Dixon’s murder. Greenfield argued the move violated Briscoe’s speedy trial rights.
The prosecution responded the additional time was required to gather essential evidence in the case.
Greenfield claimed evidence in the case was “incredibly unsatisfactory,” noting limited surveillance footage of Briscoe pumping gas 14 minutes before the shooting and casings found on the scene that were allegedly the same caliber as handgun possessed by Briscoe.
Judge Paul J. Cucuzzella ultimately sided with the prosecution, and the motion to dismiss was denied.
The trial is set to continue May 6 before Judge Melissa K. Copeland.
