A Baltimore City prosecutor said the State’s Attorney’s Office intends to retry the murder case against 24-year-old Garry Morris and join his case with his co-defendant’s following a mistrial in Morris’ latest trial on Nov. 19.
During reception court on Nov. 20, the prosecutor told Circuit Court Judge Melissa K. Copeland that Judge Althea M. Handy declared a mistrial for Morris after a five-day trial. Morris, who is represented by defense attorneys Natalie Finegar and Mary Lloyd Patton, is charged with two counts of first-degree murder in addition to firearm use in a felony or violent crime and having a handgun in a vehicle in connection to the murder of 20-year-old Amare Burruss on Dec. 7, 2022.
Patton represented Morris during Wednesday’s proceeding.
The prosecutor requested a motion’s hearing to join Morris’ case with his 24-year-old co-defendant’s, Darrean Fleming, whose case also ended with a mistrial in June. Patton objected to the motion, while a hearing was scheduled for Dec. 4.
A third co-defendant, 22-year-old Wesley Lambert, was found guilty in May and was sentenced to life in prison last month. Fleming and Lambert were represented by defense attorneys Michael Tomko and Hunter Pruette, respectively.
According to court documents and trial testimony, the three men were accused of a shootout with Burruss on the 4400 block of Park Heights Avenue. Video footage showed the co-defendants following the victim to the 4200 block of Pimlico Road, where he was shot in the head and died.
