Attempted Murder Defendant’s Request to Change Attorney Denied

An attempted murder defendant’s request to hire a new attorney before Baltimore City Circuit Court Judge Althea M. Handy on Oct. 7, was denied.

Daquann Toney, 28, is charged with attempted first- and second-degree murder, first- and second-degree assault, reckless endangerment, firearm use in a felony violent crime, firearm possession with a felony conviction, illegal possession of a regulated firearm, illegal possession of ammunition, having a handgun within 100 yards of the public, carrying a loaded handgun and firing a gun in Baltimore City in relation to an incident that occurred Aug. 13, 2023.

In court Monday, Toney expressed dissatisfaction with his defense attorney, Andrea Jaskulsky, saying he didn’t spend enough time to studying Toney’s two criminal cases.

Judge Handy stated that Jaskulsky knew the case pretty well and even hired a private investigator to find witnesses. She informed Toney that his options were to continue working with Jaskulsky or proceed by representing himself today.

The prosecution offered a plea deal of 40 years, suspending all but 25 years, for the charge of attempted first-degree murder. Jaskulsky rejected the offer on Toney’s behalf.

The trial was postponed due to a scheduling conflict with the prosecutor.
